GENERAL TERMS AND CONDITIONS OF SERVICE AND SALE
1. INTRODUCTION
1.1. These General Terms and Conditions of Use and Sale govern the terms and conditions under which STECOL FLEX S.r.l., with registered office at Via Francesco Baracca 12/14, 20056 Trezzo sull’Adda (MI), Italy (hereinafter, the “Seller”), as the owner of the online store accessible at www.redelk.it (hereinafter “RedElk” or the “Online Store”), allows Users to browse the Online Store and purchase the products featured in the catalogue online.
1.2. Browsing the Online Store, any registration of a personal account and the purchase of products are governed by these General Terms and Conditions of Use and Sale, as well as by the Privacy Policy and Cookie Policy published on the website. Submitting a purchase order through the Online Store implies full knowledge and acceptance of these General Terms and Conditions of Use and Sale in the version published at the time of the order.
2. DEFINITIONS
2.1. Item(s): outdoor sports clothing or accessories sold via the Online Store.
2.2. Sales Contract: the agreement between the User and Stecol Flex S.r.l./RedElk concerning the online sale of the Items.
2.3. General Terms and Conditions of Service and Sale or GTC: these general terms and conditions.
2.4. Privacy Policy: the policy regarding the processing of personal data, as published on the Online Store.
2.5. Parties: the User/Purchaser and the Seller, i.e. the parties entering into the Sales Contract.
2.6. Online Store: the online sports and outdoor clothing store accessible at www.redelk.it.
2.7. User or Purchaser: the consumer who uses or places orders on the RedElk.it online store.
2.8. Seller: Stecol Flex S.r.l., the company that owns the RedElk brand and operates the Online Store.
3. IDENTIFICATION OF THE SELLER
3.1. The goods covered by these general terms and conditions are offered and sold on the Online Store www.redelk.it. The Online Store, including the domain name, is operated by Stecol Flex S.r.l., registered with the Milan Chamber of Commerce under no. MI 288906 in the Register of Companies – R.E.A. MI 1297216, tax code and VAT number 09507890151, with registered office at Via Francesco Baracca 12/14, 20056 Trezzo sull’Adda (MI), Italy. Hereinafter, the company is also referred to as “RedElk”, as the Online Store through which it carries out its online sales activity.
4. SCOPE OF APPLICATION OF THE GTC
4.1. These General Terms and Conditions govern the use of the RedElk Online Store by the User. By submitting an order through the online store, the User accepts the application of these General Terms and Conditions.
4.2. The GTC apply, subject to any specific provisions that may be envisaged, to all geographical areas from which orders may be placed and to which deliveries are active. They may be amended at any time. Should local legislation provide for mandatory contractual terms that are more favourable to the consumer, such terms shall prevail over these GTC where more favourable.
4.3. Any amendments and/or new conditions shall become effective from the moment they are published in the “General Terms and Conditions” section of the Online Store. Users are therefore invited to check the most up-to-date version of the GTC periodically. In any event, the GTC in force on the date the purchase order is submitted shall remain applicable.
5. REGISTRATION WITH THE ONLINE STORE
5.1. The Online Store is reserved exclusively for users who are at least 18 years of age and who expressly declare that they are end consumers within the meaning of Article 3, paragraph 1, letter a), of Legislative Decree 206/2005 (the “Consumer Code”), and that they are purchasing for purposes unrelated to any commercial, craft, entrepreneurial or professional activity they may carry out.
5.2. RedElk reserves the right not to accept orders which, in its sole discretion, appear anomalous due to the quantity of products purchased or the frequency of purchases made on the Online Store. RedElk also reserves the right to delete users who are not consumers or who have not completed the required data entry.
5.3. It is not mandatory to create an account to purchase from RedElk; however, it is necessary to have a valid email address and to approve, by selecting the relevant box on the registration or purchase form, these GTC and the Privacy Policy. Failure to accept the GTC will make it impossible to make purchases on the Online Store.
5.4. Registration with the Online Store is free of charge. To register, the User must complete the registration form, enter their email address and click on “Submit”. Registration will be confirmed to the Purchaser by email containing the login credentials for their RedElk account.
5.5. The registration credentials must be used exclusively by the User and may not be transferred to third parties. The User undertakes to keep them strictly confidential and to ensure that no third party has access to them. The User must immediately inform RedElk in the event of suspected unauthorised use and/or disclosure of the credentials.
5.6. The User warrants that the personal information provided during the Online Store registration process is complete, accurate and truthful. The User undertakes to indemnify RedElk against any liability for damages and/or penalties arising from0 the User’s breach of the rules relating to registration with the Online Store.
5.7. By registering with the Online Store and approving these GTC, the User agrees to receive newsletters at the email address provided. The User may request not to receive further communications at any time by clicking on the relevant link at the bottom of the emails or by writing to hello@redelk.it.
6. ORDER PROCEDURE AND CONCLUSION OF THE SALES CONTRACT
6.1. The contract between RedElk and the User is concluded exclusively online, subject to acceptance of the GTC, by the User accessing the website www.redelk.it and completing the purchase procedure provided therein.
6.2. An order may be placed by selecting an Item from the Online Store, choosing the size and/or colour where applicable, and clicking on “Add to Basket”. To proceed to payment, the User must click on the “Basket” icon, where a summary of the order will be displayed including the price and the option to calculate shipping costs. If confirmed, the User may proceed by clicking on “Complete order”. Before final confirmation, the User must log in to their account or, if they do not have an account, enter the details required to process the order. They must then select the payment method and click on “Place Order”. Once payment has been accepted, the User will see the order confirmation both on the Online Store and by email to the address provided.
6.3. Conclusion of the Sales Contract. The Sales Contract is concluded upon the correct completion by the User of the order form, the execution of payment and the subsequent sending by RedElk of the order and payment confirmation by email, following the display of a printable webpage summarising the order, containing the details of the purchaser and the order, the price of the Items purchased, the shipping costs and any additional charges, the payment methods and terms, the delivery address, the delivery times and an indication of the right of withdrawal.
6.4. The order confirmation sent by RedElk to the User by email contains all information relating to the Sales Contract.
6.5. RedElk reserves the right to refuse orders for any reason and, furthermore, to cancel purchases already accepted in the presence, by way of example and without limitation, of the following circumstances, without this giving rise to liability for any damages and/or costs. In such cases, the contract shall be deemed terminated by mutual consent:
I. the Item is unavailable or no longer in stock; in this case, any payments made will be refunded. Should only part of the ordered Items be available, RedElk will contact the User to ask whether they wish to cancel the order or receive only the available products; in this case, only the amount relating to the Items actually shipped will be charged or retained;
II. the billing details provided by the User are incorrect or cannot be verified;
III. the order is flagged by security systems as potentially fraudulent. In the event of suspected fraud, before proceeding with cancellation of the order, the Seller reserves the right to carry out checks on the bank details and/or the identity of the Purchaser. Upon completion of the order, the Purchaser undertakes to provide the Seller with the information and documents necessary for such checks. In the absence of such documents or information, the Seller reserves the right to cancel the order;
IV. payment by bank transfer is not received within 5 working days from the sending by the Seller of the email containing the instructions for making the bank transfer;
V. RedElk has reason to believe that the order has been placed by a person under 18 years of age;
VI. RedElk has reasonable grounds to believe that the order has been placed by a reseller or other professional purchaser;
VII. the Item has been incorrectly priced;
VIII. RedElk is unable to deliver to the address provided.
6.6. It is not possible to make changes to the order once it has been submitted. RedElk reserves the right to assess whether to accept any requests to cancel the order received prior to shipment of the products.
6.7. RedElk reserves the right to postpone shipment should the order not be capable of being fulfilled in a single consignment. Orders placed separately will be shipped separately.
7. PRODUCT AVAILABILITY
7.1. RedElk ensures, through the telematic system used, the processing and fulfilment of orders without delay. To this end, it indicates in real time in the online catalogue which products are available and which are not, as well as the dispatch times.
7.2. Should an order exceed the quantity available in stock, RedElk will inform the Purchaser by email or telephone of the possible unavailability of the product or, alternatively, of the expected waiting time to obtain it, asking whether they wish to confirm the order or not.
7.3. The order form will be stored in RedElk’s database for the time necessary to fulfil the order and, in any event, within the limits provided for by law.
7.4. The languages available for the conclusion of the contract are as follows:

7.5. RedElk reserves the right to refuse orders from users who do not offer sufficient guarantees of solvency or with whom disputes are pending.
7.6. In the event of unavailability of the ordered product, the Purchaser will be promptly informed by email and the order will be cancelled. If payment has already been made, RedElk will refund the total amount paid by the User, including the purchase price, shipping costs and any additional charges, without undue delay and in any case within 14 days from the day following submission of the order. The refund amount will be communicated by email and credited through the same payment method used by the Purchaser.
7.7. Any delay in the crediting of the refund may depend on the bank, the type of credit card or the payment system used. In any case, the value date of the refund will be the same as that of the debit.
8. PRICES
8.1. All sales prices of the products displayed on the RedElk Online Store are expressed in euros (€) and constitute an offer to the public pursuant to Article 1336 of the Italian Civil Code. The transaction will take place in euros.
8.2. For shipments within Italy and the European Union, taxes and import duties are included in the indicated prices. For any shipments to areas outside the European Union, additional costs may apply due to customs duties or local taxes (“Additional Costs”), which shall remain at the Purchaser’s expense. Any Additional Costs may be requested by the courier upon delivery.

8.3. All prices indicated on the Online Store do not include shipping costs or any additional charges (for example: customs clearance, gift wrapping). During the purchase process, the User will be informed of the shipping costs and any other additional charges, which must be expressly approved at the time of order confirmation and will appear in the final summary.
8.4. In the event of shipments to areas outside the European Union for which Additional Costs may apply, the Purchaser, by expressly accepting them during checkout, undertakes to bear them. In the event of refusal to accept delivery of the Item or failure to collect it, except in the legitimate exercise of the right of withdrawal, the contract may be deemed terminated at the Seller’s discretion. In such a case the Seller shall be entitled to the return of the Item and shall be required to refund the price of the Item, less the Additional Costs and the cost of return. The Seller may withhold the refund until receipt of the Item.
8.5. Product prices may be changed without notice; it being understood that the price charged to the User will be the one published on the product sheet at the time the order is submitted. The products shall remain the property of RedElk until full payment of the purchase price, shipping costs and any additional charges.
8.6. Prices indicated on the Online Store and/or in advertising materials may be subject to correction by RedElk without prior notice. The prices in euros stated in the order confirmation sent to the User’s email address pursuant to Article 6.4 above shall be considered binding. RedElk is not bound by manifestly incorrect prices and reserves the right to cancel orders in the event of pricing errors or subsequent changes.
8.7. Sales periods and promotions published on RedElk may have limited duration and may differ depending on the geographical area from which the User connects. The validity period of the offers is indicated on the Online Store and/or communicated to the User by email.
9. PAYMENT METHODS AND REFUNDS
9.1. Any payment by the User may be made exclusively using one of the methods indicated on the relevant page of the RedElk Online Store.
9.2. Any refund shall be credited promptly through the same payment method used by the User for the purchase. In the event of exercise of the right of withdrawal, as governed by Article 15, the User must notify RedElk within 14 (fourteen) days from the date of receipt of the shipment.
9.3. The User may make payment using the following methods:
I. Credit and debit cards – via Stripe, a platform managed by Stripe, Inc. for the acceptance of remote payments, open to the main card schemes accepted by RedElk (Visa, MasterCard, American Express). Stripe uses secure payment systems compliant with current national and international standards. Upon confirmation of the order, the transaction details are transmitted via secure connection to the authorising bodies (banks or card issuers/operators) in order to obtain the necessary authorisations. For the protection of the User and of RedElk, credit card numbers are never disclosed to the Seller, who receives only an authorisation code that cannot be traced back to the card. The system uses security protocols such as 3D Secure, Verified by Visa, MasterCard SecureCode and anti-fraud checks. Any refunds will be credited to the same card used for the purchase.
II. PayPal – PayPal is an international payment method that allows online transactions to be carried out simply and securely. During the purchase process, by selecting “PayPal” among the payment methods, the User will automatically be redirected to the PayPal page. If already a PayPal customer, the User may log in with their credentials and confirm the payment; otherwise, they may open a PayPal account or pay by credit card without creating an account. In the event of returned goods, the amount will be credited to the account or card used for payment.
III. Bank transfer – The Purchaser may use bank transfer as an electronic payment method from their current account. The bank details and order number will be communicated by automatic confirmation email. Payment must be made within 48 hours from the sending by the Seller of the email containing the instructions and bank details for the transfer, indicating the order number in the payment reference. The order will be processed and fulfilled only after the amount due has actually been credited to the Seller’s account. If the amount is not credited within 5 working days from the sending of the aforementioned email, the Seller reserves the right to cancel the order, subject to notice to the User. If, following a bank transfer already made, one or more items are no longer available, RedElk will refund the difference by bank transfer and proceed with the shipment of the available items. Any returns will be refunded to the bank account from which payment was made, subject to communication of the IBAN by the User.
9.4. If an invoice is requested, the Purchaser must select the “Company/Invoice” option from the “Invoice type” menu at checkout and provide all information necessary for correct invoicing (VAT number and/or tax code, certified email address or SDI code). It will not be possible to request the issuance of an invoice after the payment has been processed.
9.5. The invoice must be requested by the customer at the time of purchase by entering the necessary details during the ordering procedure.
9.6. In the event of a return, the amounts credited back shall correspond to the price actually paid by the User, net of any discounts, promotions, discount codes or sales, according to the procedures provided for the payment method used.
10. DELIVERY TIMES AND METHODS
10.1. RedElk will deliver the products selected and ordered using the methods chosen by the User or indicated on the Online Store at the time of the order, as confirmed in the confirmation email and subject to receipt of the payment due.
10.2. RedElk undertakes to make delivery as quickly as possible. Shipment will take place from confirmation of the order or of payment, depending on the payment method chosen. Should RedElk be unable to make shipment within the stated terms, it will promptly notify the User by email. Should shipment not be possible within 30 days from the order being placed, the User shall be entitled to withdraw from the purchase contract and to obtain reimbursement of any sums paid, unless otherwise agreed between the Parties.

10.3. The delivery times for each product will be specifically indicated during the purchase procedure and, in any event, before completion thereof.
10.4. Deliveries are made from Monday to Friday, excluding public holidays, through express couriers selected by RedElk. RedElk reserves the right to use, from time to time, the courier deemed most suitable in relation to the destination and the characteristics of the shipment.
10.5. Delivery shall be deemed complete when the product is made available to the User at the delivery address indicated on the order form. Delivery to an upper floor or by appointment is not provided.
10.6. In the event of failed delivery due to the recipient’s absence at the specified address, the courier will leave a delivery notice containing instructions to request a second delivery attempt or to manage the delivery online. After three unsuccessful attempts, the parcel will go into storage. In such a case, RedElk Customer Care will contact the Purchaser to agree how to release the parcel from storage and facilitate delivery as quickly as possible. If necessary, RedElk may agree with the User to change the delivery address. If the subsequent attempt is also unsuccessful, or in the absence of any reply from the User, the parcel will be returned to RedElk and the User will be informed by email. After 30 days from the return of the parcel to RedElk, the contract shall be deemed terminated due to impossibility of delivery attributable to the Purchaser, pursuant to Article 1456 of the Italian Civil Code.
10.7. In the event of failed delivery due to causes attributable to the User, such as, by way of example, an incorrect or incomplete address, failure to collect the parcel or unavailability of the recipient, the contract shall be deemed terminated. In such a case, RedElk shall refund the amount paid by the User, net of shipping, storage and return costs. Termination of the contract and the refund amount shall be communicated by email. The refund shall be made through the same payment method used for the purchase.
10.8. If, within 30 days from the failed delivery, the User requests a new shipment of the product, RedElk will proceed with a new delivery subject to payment of the shipping costs, as well as any storage and return costs.
11. LIMITATIONS OF LIABILITY
11.1. RedElk accepts no liability for disruptions attributable to force majeure preventing performance of the order within the timeframes provided by the contract, including, by way of example, natural events, acts of terrorism, strikes, network malfunctions and blackouts.
11.2. Except in cases of wilful misconduct or gross negligence, RedElk shall not be liable to the User for disruptions or malfunctions connected with the use of the Internet beyond its control or that of its subcontractors.
11.3. RedElk shall not be liable for damages, losses or costs suffered by the User as a result of non-performance of the contract for reasons not attributable to RedElk. In such cases, the User shall be entitled solely to full reimbursement of any price paid and any ancillary charges incurred.
11.4. Under no circumstances may the User be held liable for delays or errors in payment if they prove that they made payment in the time and in the manner indicated by RedElk. It is understood that RedElk shall not be liable for delays in the receipt of payments attributable to payment systems managed by third parties and may delay confirmation of the order until actual confirmation of payment.
11.5. The images and colours of RedElk products published on the Online Store may differ from the actual ones due to the settings of the devices used by the User for viewing. RedElk undertakes to correct as soon as possible any errors in product descriptions. Such errors may be reported to the email address hello@redelk.it.
12. LIABILITY FOR DAMAGE CAUSED BY DEFECTIVE PRODUCTS
12.1. Pursuant to Articles 114 and 116 of Legislative Decree no. 206 of 6 September 2005 (Consumer Code), the manufacturer is liable for damage caused by defects in the product. If the manufacturer is not identified, RedElk, as supplier, shall be liable if it fails to communicate to the injured party, within 3 months of the request, the identity and address of the manufacturer or of the party that supplied the product to RedElk.
12.2. The injured party’s request must be made in writing and must indicate the product that caused the damage, the place and date of purchase; it must also contain an offer to make the product available for inspection, if it still exists.
12.3. RedElk shall not be held liable for the consequences deriving from a defective product if the defect is due to the product’s compliance with a mandatory legal provision or a binding measure, or if the state of scientific and technical knowledge at the time the manufacturer put the product on the market did not yet allow it to be considered defective.
12.4. No compensation shall be due if the injured party was aware of the defect in the product and of the resulting danger and nevertheless voluntarily exposed themselves to it.
12.5. In any case, the injured party must prove the defect, the damage and the causal link between the defect and the damage.
12.6. The injured party may claim compensation for damage caused by death or personal injury, as well as by destruction of or damage to an item other than the defective product, provided that it is ordinarily intended for private use or consumption and was mainly used by the injured party for such purposes.
12.7. Pursuant to Article 123, paragraph 2, of Legislative Decree no. 206 of 6 September 2005, damage to property shall be compensated only insofar as it exceeds the amount of €387.00.
13. WARRANTIES AND SUPPORT PROCEDURES
13.1. RedElk, pursuant to Article 130 of the Consumer Code, is liable for any lack of conformity that becomes apparent within 2 years from delivery of the goods.
13.2. For the purposes of this contract, consumer goods are presumed to be in conformity with the contract if, where relevant, the following circumstances apply:
a) they are fit for the purposes for which goods of the same type are ordinarily used;
b) they conform to the description given by the Seller and possess the qualities of the goods presented to the Consumer as a sample or model;
c) they possess the quality and performance usual in goods of the same type, which the Consumer may reasonably expect, taking into account the nature of the goods and, where appropriate, the public statements made by the Seller, the manufacturer or its agent or representative, particularly in advertising or on labelling;
d) they are also fit for the particular purpose intended by the Consumer and made known to the Seller at the time of conclusion of the contract, provided that such purpose has also been accepted by conclusive conduct.
13.3. The Purchaser is invited to report any lack of conformity without delay and preferably within a few days of discovery, in order to enable RedElk to deal with the request more quickly. In any event, the Purchaser’s rights pursuant to Articles 135-bis et seq. of the Consumer Code remain unaffected.
13.4. Unless proven otherwise, any lack of conformity that becomes apparent within 1 year from delivery of the goods shall be presumed to have already existed on that date, unless such presumption is incompatible with the nature of the goods or the lack of conformity.
13.5. In the event of lack of conformity, the Purchaser is entitled to have the goods brought into conformity free of charge, by repair or replacement, at their choice, unless the remedy requested is impossible or excessively burdensome for the Seller pursuant to Articles 135-bis et seq. of the Consumer Code. The Purchaser may also request a proportionate reduction of the price or termination of the contract in the cases provided for by law.
13.6. The Purchaser must notify RedElk of the lack of conformity using the contact details indicated on the website. RedElk will respond as quickly as possible, indicating how the request will be handled. If the request is accepted, RedElk will also indicate the methods for shipping or returning the goods and the expected time required to restore conformity by repair or replacement.
13.7. If repair or replacement is impossible or excessively burdensome, or if RedElk has not carried it out within a reasonable period, or if the repair or replacement already carried out has caused considerable inconvenience to the Purchaser, the latter may request, at their choice, an appropriate reduction of the price or termination of the contract. In such case, the Purchaser must send the relevant request to RedElk, which shall communicate within 7 working days its willingness to comply or the reasons preventing compliance. In the same communication, should RedElk accept the request, it shall indicate the proposed price reduction or the methods for returning the defective goods. In such cases, it shall be the Purchaser’s responsibility to indicate the method for reimbursement of any sums paid.
13.8. The Seller specifies that repair or replacement times may depend on suppliers’ response times. RedElk therefore reserves the right to contact product suppliers before confirming any repairs, replacements or price reductions to the User, in order to verify availability, warranty conditions and the methods for handling the defective product.
14. USER’S OBLIGATIONS
14.1. The User undertakes to pay the price of the purchased goods within the times and by the methods indicated in the contract.
14.2. Once the online purchase procedure has been completed, the User undertakes to print and keep these GTC.
14.3. The User undertakes to notify RedElk promptly of any changes of address and/or relocation of premises. Failure to provide such notification shall remain entirely at the User’s own expense and risk. Until any such change is communicated, the User shall be deemed domiciled at the address indicated at the time of the order and shall remain liable for the Item ordered.
14.4. The User acknowledges that the information contained in these GTC has already been viewed and accepted before confirmation of the purchase order, as this step is made mandatory by the system.
15. RIGHT OF WITHDRAWAL – RETURNS AND REFUNDS
15.1. The User has the right to withdraw from the concluded contract, without any penalty and without giving any reason, within 14 (fourteen) calendar days from the day on which they received the purchased goods.
The consumer may also use the standard withdrawal form made available on the website on the page [insert URL], it being understood that withdrawal may also be exercised by means of any other explicit declaration sent to the contact details indicated above.
15.2. Should the Purchaser intend to exercise the right of withdrawal, they must notify RedElk through the dedicated contact form available on the Online Store at the link www.redelk.it/contatti, indicating in the subject line “Return request for order no. xxxx” and entering the required details, the order number and a telephone contact number; alternatively, they may send an email containing the same details to hello@redelk.it.
Following the request, the User will receive by email from Customer Service the instructions to proceed with returning the goods, as well as information concerning the return costs and the procedure to follow for any booking of collection through a partner courier.
15.3. Within 14 (fourteen) calendar days from communicating withdrawal, and in accordance with the instructions received from RedElk Customer Service, the User must arrange for shipment of the purchased product(s), adequately protected and packaged, preferably in the original packaging, accompanied by the original tag and all product accessories, if any (by way of example: protective bags, spare parts, warranties, etc.).
The User may use the carrier partnered with RedElk, which may be booked through Customer Service, or arrange the return shipment independently, it being understood that the costs of returning the product shall in any event be borne entirely by the User.
For the correct exercise of the right of withdrawal, the Item must be returned intact, complete and, where possible, in the original packaging or, in any event, in packaging suitable to ensure its correct preservation during transport. The Customer must also indicate clearly the order number and the details of the return request, in accordance with the instructions received from Customer Service.
Pursuant to the Consumer Code, the User is liable for any reduction in the value of the goods resulting from handling of the product other than that necessary to establish its nature, characteristics and functioning. The products must therefore not have been improperly used, washed, worn beyond the time necessary for trying them on, damaged, altered, soiled or deprived of labels, tags or accessories.
To obtain full reimbursement of the price paid, the Item must be returned in normal condition and with the original labels still attached. If the above conditions are not met, in whole or in part, RedElk reserves the right to refuse the return or to reduce the refund amount in proportion to the decrease in the value of the product, within the limits permitted by law. If the return is not acceptable and the product must be sent back to the User, the related shipping costs shall be borne by the User.
15.4. The return fee varies depending on the geographical area of shipment of the parcel. The relevant amount, where applicable in the event of use of the return service organised by RedElk, shall be communicated to the User and shall in any event remain at the User’s expense. This cost may be deducted from the refund, once the integrity of the returned product(s) has been verified and the admissibility of the withdrawal has been confirmed.

15.5. Should the User decide to return the Item with a shipment arranged independently, they must make a trackable shipment addressed to: RedElk c/o Stecol Flex S.r.l. – Via Francesco Baracca 12/14 – 20056 Trezzo sull’Adda (MI). In the event of a non-trackable, lost, damaged or undelivered shipment to the Seller’s warehouse, RedElk declines all liability and will not be able to proceed with any refund.
RedElk shall refund without undue delay and in any event within 14 (fourteen) days from the day on which it is informed of the User’s decision to withdraw from the contract. It is understood that, pursuant to law, RedElk may withhold the refund until receipt of the returned product or until the User has provided proof of having sent back the product, whichever is earlier. The refund shall be made through the same payment method used for the purchase, unless otherwise agreed between the Parties. In any event, the costs of returning the goods remain at the User’s expense.
15.6. The refund amount shall be communicated by email and credited through the same payment method used by the Purchaser for the purchase, unless otherwise agreed between the Parties. In the event of a return, the amounts credited shall correspond to the price actually paid by the User for the returned product, net of any discounts, promotions, discount codes or sales. Under no circumstances shall the costs incurred by the User for returning the product or any additional costs arising from the User’s choice of delivery methods other than the standard ones possibly offered by the Seller be refunded.
15.7. Upon receipt of the communication exercising the right of withdrawal, the Parties shall be released from their reciprocal obligations deriving from the contract, subject to the provisions of this article and without prejudice to the User’s obligation to return the product according to the methods and within the time limits set out above.
15.8. Any request for a size change or for replacement of the product for reasons other than the exercise of the right of withdrawal or the legal guarantee of conformity constitutes a courtesy granted by the Seller on a goodwill basis and not an automatic right of the User. Such request is in any event subject to availability of the product or of the requested size and to the Seller’s acceptance of the return, subject to verification of the integrity and conformity of the returned product. Any shipping costs for the replacement product shall be communicated by Customer Service before confirmation of the replacement and, unless otherwise indicated by the Seller, shall remain at the User’s expense.
16. GROUNDS FOR TERMINATION
16.1. The obligations referred to in Article 14 assumed by the Purchaser, as well as the guarantee of successful completion of payment made by the means referred to in Article 9.3, and the exact fulfilment of the obligations undertaken by RedElk in Article 13, are of an essential nature. Therefore, by express agreement, breach of even one of such obligations, unless caused by force majeure or unforeseen circumstances, shall result in termination as of right of the contract pursuant to Article 1456 of the Italian Civil Code, without the need for judicial decision. The effects of termination shall arise 15 days after receipt of the registered letter with return receipt or certified email (PEC) contesting the breach, in the absence of performance within such term.
17. PRIVACY POLICY
17.1. Stecol Flex S.r.l., as data controller of the data collected through RedElk.it, protects the privacy of its Users/Purchasers and guarantees that the processing of personal data is compliant with Regulation (EU) 2016/679. Users/Purchasers are invited to read the Privacy Policy carefully before accessing the Online Store.
17.2. The User may withdraw their consent at any time by writing to hello@redelk.it.
18. METHOD OF STORING THE CONTRACT
18.1. Pursuant to Article 12 of Legislative Decree 70/2003, RedElk informs the Purchaser that every submitted order is stored in digital and/or paper format on the servers and/or at the premises of Stecol Flex S.r.l. and of the related hosting service, according to criteria of confidentiality and security.
19. COMMUNICATIONS AND COMPLAINTS
19.1. The Purchaser may request any information and/or send communications and/or submit complaints concerning sales, purchase orders, products, payments and shipments. Such communications and any complaints shall be valid if sent by email to hello@redelk.it. The Purchaser shall indicate in the registration form the telephone number or email address at which they wish to receive communications from RedElk. For notices of withdrawal, please refer to Article 15.
20. GOVERNING LAW AND SETTLEMENT OF DISPUTES
20.1. Contracts concluded between users of the Online Store and RedElk are governed by Italian law. In particular, the provisions of Articles 50 et seq. of the Consumer Code shall apply.
20.2. Any dispute relating to the application, execution or interpretation of these General Terms and Conditions of Sale shall fall within the jurisdiction of the court of the place where the User resides or has elected domicile.
20.3. This is without prejudice to the Purchaser’s right to bring proceedings before the ordinary courts. In the event of disputes between the Purchaser and RedElk, the Parties may also initiate online out-of-court settlement procedures for consumer disputes, pursuant to Article 141, paragraph 1, of the Consumer Code. In the event of service disruptions or disputes, RedElk hereby undertakes to participate in an attempt at amicable conciliation which the Purchaser may initiate pursuant to Article 141, paragraph 3, of the Consumer Code before RisolviOnline, an independent institutional service provided by the Arbitration Chamber of the Milan Chamber of Commerce, aimed at reaching a satisfactory agreement with the assistance of a neutral and competent conciliator. For further information or to submit a conciliation request, the Purchaser may access the RisolviOnline.com service.
21. FINAL PROVISIONS
21.1. This contract repeals and replaces any previous agreement, understanding, negotiation, whether written or oral, entered into between the Parties and concerning the same subject matter.
21.2. RedElk reserves the right to modify, suspend or discontinue sales on the Online Store. RedElk shall in no way be held liable to the User or to third parties for such modifications, suspensions or discontinuations.
21.3. RedElk reserves the right to amend or update these General Terms and Conditions of Sale at any time. Users are invited to consult the most recent version available on the website, as well as the related update date. In any event, the General Terms and Conditions of Sale in force at the time of conclusion of the contract shall remain applicable.
